Bellevue Asset Management is an authorized manager of collective assets of collective investment schemes subject to regulation by the Swiss Financial Market Supervisory Authority FINMA. As such, it is in compliance with all regulatory and legal requirements placed upon managers of collective investment schemes. Bellevue Asset Management is responsible for the operating activities of BB Biotech AG and for the investment management operations of the Bellevue Funds (Lux) SICAV and other investment funds and mandates.

The Swiss Financial Services Act (FINSA)
The Swiss Financial Services Act (FinSA) came into force on 1 January 2020. Its aims include strengthening investor protection and the Swiss financial centre, as well as creating comparable conditions for financial service providers. Most of the provisions will apply from January 2022 following a two-year transition period.
The FinSA essentially contains regulations on the provision of financial services and the offering of financial instruments and is intended to improve investor protection. In terms of content, the FIDLEG is closely aligned with the reforms of EU regulations and mainly covers the following areas:
- Optimisation of investor protection
- Transparency of financial products
- Revision of organisational requirements for the provision of services
FinSA concerns all financial services provided to clients domiciled in Switzerland or to clients abroad from Switzerland.
Bellevue Asset Management AG is a wholly owned subsidiary of Bellevue Group AG. Bellevue Asset Management AG is subject to the Financial Institutions Act (FinIA) and is supervised by the Swiss Financial Market Supervisory Authority (FINMA) as a manager of collective assets of collective investment schemes.

FINOS generally only becomes active after the client has confronted the manager of collective assets with the complaint in writing and the latter has had the opportunity to take a stand.

The legislation establishes three client classifications: ‘Retail’ (non professional), ‘Professional’ and ‘Institutional’ clients. A change of the client classification can be requested by the client in writing which results in changes in the product offering and investor protection at the same time.The following overview describes the three client classifications and their effects on investor protection.

1 For “execution only” transactions without Credit Suisse advice, only Knowledge and Experience is checked for ‘Retail’ clients (non professional).
2 ‘For ‘Professional’ clients it can be assumed that they have the required level of knowledge and experience and that they can financially bear the investment risks associated with the financial service. For “execution only” transactions without Credit Suisse advice, neither an appropriateness nor a suitability assessment is conducted.
3 ‘Professional’ clients can waive advisory minutes so they are not being produced. Without the waiving request advisory minutes are provided to ‘Professional’ clients on request.
4 Exception: ‘Retail’ clients (non professional) having a long-term asset management or investment advisory mandate with a FINMA-licensed Swiss financial intermediary or a foreign financial intermediary subject to equivalent supervision (e.g. Credit Suisse) may be treated as ‘Qualified Investors’ pursuant to CISA and may receive advice related to funds restricted to ‘Qualified Investors’. Their classification according to FinSA remains ‘Retail’ (non professional) and is not impacted by their ‘Qualified Investors’ status.
5 Being a ‘Professional’ client under FinSA, you become automatically a ‘Qualified Investors’ under CISA and have access to funds not meeting the Swiss distribution criteria (additional restrictions apply to funds without Swiss Representative and Paying Agent).
